Terms of Use

1. Acceptance of Terms

By accessing or using ArcOps (“the Service”), operated by DEVCENTRUM SRL (“we”, “us”, “our”), you agree to be bound by these Terms of Use. If you do not agree to these terms, you must not use the Service.

These terms constitute a legally binding agreement between you and DEVCENTRUM SRL, a company incorporated under the laws of Romania, regarding your use of ArcOps.

2. Description of Service

ArcOps is a project management and product sourcing platform built for interior designers in Europe. The Service includes:

  • Product search and comparison across 50+ European furniture retailers
  • Stage-based project workflow management with Kanban boards
  • Client collaboration via shareable stage links
  • Product libraries for saving and organising favourites
  • Profit tracking and markup management per product, stage, and project
  • Team management and role-based access control

3. Account Registration

To use ArcOps, you must create an account by providing a valid email address and password. You are responsible for:

  • Providing accurate and complete registration information
  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorised use of your account

You must be at least 16 years old to create an account, in accordance with GDPR Art. 8.

4. Pre-Launch Waitlist

Prior to the full launch of ArcOps, users may join a waitlist to reserve early access. By joining the waitlist:

  • You confirm that you have read and agree to our Privacy Policy
  • You understand that waitlist registration does not guarantee access to any specific features or timeline
  • Founding members (those who join the waitlist before launch) are eligible for 6 months of free access to any paid plan upon launch
  • The founding member benefit is non-transferable and applies to a single account only

5. Subscription Plans & Billing

ArcOps offers the following subscription plans:

  • Free — 1 active project, 2 team members, limited product search. Free forever, no credit card required.
  • Starter (€19/month or €194/year) — 5 active projects, 5 team members, full product search, product libraries, custom stage sharing.
  • Professional (€39/user/month or €398/user/year) — Unlimited projects and team members, full product search, profit tracking and reports, priority support.

All prices are in Euros (EUR) and are exclusive of VAT where applicable. Billing occurs at the start of each billing period (monthly or annually). Prices may be adjusted with 30 days’ written notice.

6. Free Trial & Founding Member Benefits

Founding members who joined the waitlist before launch receive 6 months of free access to any paid plan. After the free period ends:

  • You may continue on the Free plan at no cost
  • You may choose a paid plan, and billing will begin after the free period expires
  • No credit card is required to start the free period
  • We will send a reminder email at least 14 days before the free period ends

7. Cancellation & Refunds

You may cancel your paid subscription at any time through your account settings. Upon cancellation:

  • Your subscription remains active until the end of the current billing period
  • You will not be charged for subsequent billing periods
  • No refunds are provided for partial billing periods
  • Your data will be retained for 30 days after the end of your subscription, after which it will be permanently deleted unless you request earlier deletion

8. Acceptable Use

You agree not to use ArcOps to:

  • Violate any applicable laws or regulations, including GDPR and EU consumer protection laws
  • Upload or share content that is illegal, defamatory, harassing, or infringes on third-party rights
  • Attempt to gain unauthorised access to the Service, other accounts, or our systems
  • Interfere with or disrupt the Service or the servers and networks connected to it
  • Scrape, crawl, or use automated tools to extract data from the Service beyond your normal use
  • Resell, sublicense, or redistribute the Service or any data obtained through it
  • Use the product search feature to systematically extract retailer pricing data for commercial resale

We reserve the right to suspend or terminate accounts that violate these terms, with notice where possible.

9. Intellectual Property

Our property: ArcOps, including its design, code, branding, documentation, and all associated intellectual property, is owned by DEVCENTRUM SRL. You are granted a limited, non-exclusive, non-transferable licence to use the Service for its intended purpose during your subscription.

Your content: You retain ownership of all content you upload to ArcOps, including project data, product selections, client notes, and files. By uploading content, you grant us a limited licence to store, process, and display it as necessary to provide the Service.

10. User Content

You are solely responsible for all content you upload, share, or create within ArcOps. You represent and warrant that:

  • You have the right to upload and share the content
  • The content does not infringe on any third-party intellectual property rights
  • The content complies with applicable laws, including GDPR when sharing client-related data

We do not monitor or review user content, but we reserve the right to remove content that violates these terms upon notice.

11. Third-Party Links & Products

ArcOps aggregates product data from third-party retailers (such as IKEA, JYSK, Westwing, and others) to enable product search and comparison. Please note:

  • ArcOps is not affiliated with, endorsed by, or sponsored by any of the listed retailers
  • Product information (prices, availability, images) is sourced from publicly available data and may not always be current or accurate
  • Purchases are made directly from the respective retailers, subject to their own terms and conditions
  • ArcOps is not responsible for the products, services, or policies of third-party retailers

12. Limitation of Liability

To the maximum extent permitted by applicable law, DEVCENTRUM SRL shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

  • Loss of profits, revenue, or business opportunities
  • Loss of data or content
  • Business interruption
  • Errors in product pricing or availability data sourced from third-party retailers

Our total liability for any claim arising from or related to these terms shall not exceed the amount you paid us in the 12 months preceding the claim, or €100, whichever is greater.

13. Disclaimer of Warranties

ArcOps is provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee that the Service will be uninterrupted, error-free, or secure. We do not warrant the accuracy, completeness, or reliability of any product data obtained through the Service.

14. Indemnification

You agree to indemnify and hold harmless DEVCENTRUM SRL, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Content you upload or share through the Service

15. Governing Law

These Terms are governed by and construed in accordance with the laws of Romania, without regard to its conflict of law provisions. Where applicable, EU regulations (including GDPR, the Consumer Rights Directive 2011/83/EU, and the Digital Services Act) shall take precedence.

Any disputes arising from these Terms shall be submitted to the competent courts of Romania. Before initiating legal proceedings, both parties agree to attempt to resolve disputes through good-faith negotiation for a period of 30 days.

16. Changes to Terms

We may modify these Terms at any time. If we make material changes, we will notify you via email at least 30 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the modified Terms.

If you do not agree to the modified Terms, you may cancel your account before the changes take effect.
